Terms of Service

These Terms of Service ("Terms") set the conditions for the Mind Craft Fish app and parent web dashboard (together, the "Service") provided by Houjun Co., Ltd. ("we").

1. Scope

These Terms apply to the conditions for providing the Service and to rights and obligations between us and users. The Privacy Policy and other rules shown in the Service form part of these Terms.

2. Agreement

1. A user agrees to these Terms by using the Service.
2. When allowing a minor to use the Service, the parent agrees to these Terms and supervises that use.

3. The Service

1. The Service provides learning games, aquarium care and parent-management features.
2. Without an account, the app works offline and stores progress on the device.
3. An optional parent account enables cloud saves and the web dashboard.

4. Accounts

1. Account registration is optional and must be completed by an adult parent or guardian.
2. Users must keep email addresses and passwords accurate and secure.
3. To the extent permitted by law, the user is responsible for loss caused by improper account management or third-party use.
4. A user may delete the account at any time after identity confirmation. Data after deletion is handled under the Privacy Policy.

5. Fees and paid services

1. The Service is currently free and contains no advertising or in-app purchases.
2. If optional paid content or parent features are offered later, price, content and conditions will be shown in advance and user agreement will be obtained.
3. Purchases, charges and refunds through a platform generally follow that platform's terms.

6. Prohibited conduct

Users must not do any of the following:

1. Violate law or public order and morals.
2. Improperly alter, analyse or copy the Service or save data.
3. Place excessive load on servers or networks or interfere with operation.
4. Infringe our rights or the rights of a third party.
5. Use unauthorised access or improper means to obtain in-game items.
6. Any other conduct we reasonably determine to be inappropriate.

7. Intellectual property

1. Rights in software, design, text, images, audio and other Service content belong to us or their lawful owners.
2. Kanji data uses KanjiVG (CC BY-SA) under that licence.
3. Service content must not be copied, republished, modified or redistributed without permission.

8. Changes, suspension and termination

1. We may change or add Service content when necessary.
2. The Service may be suspended temporarily for maintenance, faults, disasters or other unavoidable reasons.
3. If the Service is terminated, reasonable advance notice will be provided.

9. Warranties and liability

1. We do not guarantee a particular learning result, fitness for a particular purpose, uninterrupted operation or complete absence of defects.
2. Except for wilful misconduct or gross negligence, we are not liable for loss caused by use or inability to use the Service to the extent permitted by law.
3. Where liability applies, and subject to mandatory law, it is limited to ordinary and direct loss.
4. To protect progress stored only on a device without an account, use optional parent-account cloud saves when appropriate.

10. Changes to these Terms

Changes will be posted on this page. Changes that materially affect user rights will be explained clearly in advance in the app or by registered email.

11. Governing law and jurisdiction

These Terms are governed by Japanese law. The Tokyo District Court will be the exclusive court of first instance for disputes relating to the Service.

12. Use through the App Store

1. These Terms are between the user and us; Apple is not a party.
2. We provide, maintain and support the Service.
3. If the Service fails an applicable warranty, the user may notify Apple and Apple may refund the purchase price where applicable.
4. We handle third-party claims relating to the Service within these Terms and applicable law.
5. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against the user.
